The precise details were these:
Our client was staying at the Premier Inn Hotel, attending a wedding reception and party in a nearby venue on New Year’s Eve 2009. After the celebrations, he returned to the hotel, went straight to his room and started getting changed for bed. The fire alarm sounded; so he quickly re-dressed and left his room to evacuate by the nearest fire exit.
He opened the door which led to an external flight of stairs. He stepped out and slipped on the icy stairs and fell down the flight of stairs and landed at the bottom in a curled up position. He sustained a deep laceration to his head, general bruising to his thigh and chipped part of his front tooth requiring dental work. He also damaged his clothing and lost an expensive watch costing in excess of £2,250 in the accident. He was only aware of the lost watch later when he was making his way to the hospital in a taxi.
Liability was denied and we had to issue proceedings. The Defendant eventually agreed to deal with the claim but they were only offering £4,000 for the claim. We maintained the claim was valued in excess of £11,000 and made an offer to settle at £11,300. The Defendant made improved offers closer to the trial date and the parties eventually agreed to settle at £11K, just a week before the trial was due to take place.
The client, naturally, was very pleased with the outcome.
