The precise details were these:
Our client, Mrs F, while crossing the road, stepped into a pothole, causing her to lose her balance. This caused her to fall and thereby sustain a fracture to her ankle.
The Local Authority denied liability on the basis that they had fulfilled their obligation under the Highways Act. In this regard they sought to rely on both the inspection/repair reports of the carriageway and the evidence of their inspectors.
With the Defendant unwilling to accept liability and to settle, the matter proceeded to trial.
Through the industry of our solicitors, Mrs F was successful in proving the inspections undertaken were defective and that the Local Authority was indeed liable.
As a result, she was awarded £8,500 and was, naturally, very pleased with the outcome.
