Nolo’s Plain-English Law Dictionary defines personal injury as:
“An injury not to property, but to the body, mind, or emotions.
“For example, if you slip and fall on a banana peel in the grocery store, personal injury covers any actual physical harm (broken leg and bruises) you suffered in the fall as well as the humiliation of falling in public, but not the harm of shattering your watch.”
A personal injury can be a physical injury, disease or illness; or a psychological injury or illness. It can have long or short term effects, or even result in death.
The term personal injury covers a broad range of injuries and accident types and is most commonly used to refer to a type of lawsuit alleging that the claimant’s injury has been caused by the negligence of another, but also arises in cases of slander and libel.
Examples of personal injuries are:
• an injury at work. This includes work-related illnesses such as a disease caused by working with asbestos
• a psychological illness caused by stress at work
• an injury at home
• an accident on holiday
• an injury caused in a traffic accident
• an injury received as a result of faulty goods or services
• an injury caused if you trip over paving stones
• a psychological illness suffered as a result of abuse as a child
• an injury caused by errors in hospital treatment or by vaccinations
• an physical or psychological injury sustained by a victim in the course of a crime
• a psychological illness caused by discrimination or harassment in your work-place.
Where you have been injured physically, mentally, or emotionally through the actions of another, whether intentionally or unintentionally, you have a right to receive full and fair compensation for all of your harms and losses, under the law.
Unfortunately, very often the parties responsible for your injuries – or their solicitors – will try to take advantage of you when you are at your most vulnerable and will try to lessen or eliminate your right to compensation. It is for this reason that it is vital that you turn to a personal injury solicitor in order to protect your legal rights.
In turning to a solicitor for assistance in such a case, it is important that you turn to one who is expert and specialized in the field of personal injury. The law is a complex and involved subject and no one solicitor can be a master of all aspects. Solicitors specialize in specific areas of law, and so to obtain the best results possible in your case you must turn to a law firm whose solicitors are experienced in personal injury.
