The Legal Position

If you believe your marriage can be saved we can refer you to services that may help. We are under a duty to save a marriage if at all possible. However, if you believe that the marriage has broken down, to obtain a divorce you have to prove one of the following facts:

• A. Your spouse has committed adultery and you find it intolerable to live with them.
• B. Your spouse has behaved in such a way that you cannot reasonably be expected to live with him or her.
• C. Your spouse has deserted you and you have seperated for two years.
• D. You have been living apart for two years and your spouse agrees to a divorce.
• E. You have been living apart for five years
