Family Law

 

Family Law refers to those aspects of the law dealing with the family and domestic relations.

Family Law encompasses such issues as marriage, civil unions and domestic partnerships. It deals with issues arising throughout marriage such as domestic violence, legitimacy, wardship, adoption, surrogacy, child abuse and child abduction. It addresses those things which arise when marriages and partnerships break down such as divorce, annulment, property settlements, child maintenance, contact and parental responsibility orders.

It can either be public law, that aspect of the law governing the relationship between individuals (citizens, companies) and the state; or private law, that aspect concerned with the relationships between individuals.

Family Law deals with a host of authorities, agencies and groups which may be involved in or have some say in the outcome of private disputes or social decisions involving Family Law.

Family law cases are heard in both County Courts and Family Proceedings Courts (Magistrates Court), both of which operate under codes of Family Procedure Rules. There is also a specialist division of the High Court of Justice, the Family Division, where Family Law Cases can be heard.

Naturally, from time to time conflicts will arise, either within the family or affecting the family as a unit; and it is under these circumstances that legal advice may be needed to resolve the situation.
