John was walking home from a night out with friends when he broke his ankle falling into a roadside trench which had been left unguarded at the side of the road.
Although we visited the scene and took photographs of the trench it was never clear as to who was responsible for either digging the trench in the first place or failing to fill it in.
We initially contacted the local authority who denied responsibility after which we were passed round a number of utility companies all of whom denied their involvement. Faced with this "impasse" situation we decided to instruct an expert civil engineer to excavate the area where the trecnh had been to discover which services lay beneath. These investigations proved that the water utility were responsible even though they had strenuously denied liability. Armed with our new evidence they had no choice but to settle. Subsequently we managed to agree settlement in the sum of £10,000 compensation for John's pain and suffering. As with all of our accident claim clients, John kept all of his compenstion.
