Mr Jenkins was injured when he tripped and fell over a protruding stump standing proud of its surrounding area by around 6 inches in a local public house beer garden where he worked.
Mr Jenkins was employed as a Waiter and he was carrying a tray full of empty beer glasses back to the kitchen area when he tripped over a tree stump and sustained a fractured ankle.
Witnesses were reluctant to come forward in fear of being treated differently in the workplace. In the end, witness evidence was not required and a claim was submitted to the Brewery Company who agreed to settle his compensation claim by paying compensation in the amount of £2,150.
