The Legal Position

Initially the Court had jurisdiction in calculating the maintenance that normally a father would pay to the mother for child support. The Child Support Act was passed which has caused extreme unfairness both to mothers and fathers. The Child Support Act regulates the amount of maintenance payable for a child and has virtually ousted the jurisdiction of the Court.

Due to the bad name of the Child Support Agency the Government tried to re-brand and call it the Child Maintenance and Enforcement Commission. This has no impact whatsoever other than a change in its effectiveness in enforcement.

We are also being told there will be a new formula to calculate the child support in 2011, which could cause further disruption and confusion to both mothers and fathers.

If the absent parent is not paying child support then other action can be taken under schedule 1 of the Children Act 1989. This application will involve the Court where a party can pursue a lump sum or property adjustment for the sole benefit of the child.

What Can You Do?

You can contact this office so the child support formula can be explained to you and can give an indication as to the amount an absent parent should pay.
